Welcome to The Shindig! These Terms of Service ("Terms") govern your use of theshindig.io and all related services. By creating an account or using The Shindig, you agree to these Terms.

1. What The Shindig Is

The Shindig is an event invitation platform that lets you create beautiful invitations, send them via email and SMS, and track RSVPs — all in one place. We handle the logistics so you can focus on the party.

2. Account Creation

To use The Shindig as a host, you need to create an account with a valid email address and password. You're responsible for keeping your login credentials secure. If someone accesses your account because you shared or lost your password, that's on you — but reach out and we'll help you lock things down.

3. Acceptable Use

You agree to use The Shindig for legitimate event invitations. That means:

• No spam — don't add people who haven't agreed to be invited
• No illegal activity or events promoting illegal activity
• No harassment, threats, or hate speech in your invitations or messages
• No impersonation of other people or organizations
• No uploading malware or attempting to compromise our systems

We reserve the right to suspend or terminate accounts that violate these rules.

4. Payment Terms

The Shindig offers both subscription plans and credit packs. Here's how they work:

• Subscriptions are billed on a recurring basis (monthly or annually) and give you access to premium features as described on our pricing page.
• Credit packs are one-time purchases for SMS credits and other consumable features. Credits do not expire.
• All prices are in USD and processed securely through Stripe.

5. Refund Policy

• Used credits: No refunds on credits that have already been used (e.g., SMS messages that have been sent).
• Unused credit packs: We'll refund unused credit packs within 30 days of purchase if you haven't used any credits from that pack.
• Subscription cancellation: You can cancel your subscription at any time. We'll prorate your refund based on the remaining time in your billing period.

6. SMS & Text Messages (TCPA Compliance)

The Shindig sends SMS messages to event guests on behalf of hosts. Here's how consent works:

• Hosts provide guest phone numbers for the purpose of sending event invitations and reminders.
• Guests consent to receive text messages by replying YES to our initial opt-in message or by providing their phone number during RSVP.
• Guests can opt out at any time by replying STOP to any message.
• Message frequency varies based on event activity. Message and data rates may apply.
• We use Twilio as our SMS provider. Messages are sent from short codes or standard phone numbers.

7. Guest Data & Data Handling

When hosts create events and add guests, we store guest information (names, emails, phone numbers) solely to facilitate invitations, RSVPs, and event communication. Here's what you should know:

• Guest data is associated with the event it was provided for.
• When an event is deleted, all guest data for that event is permanently deleted.
• When a host deletes their account, all their events and associated guest data are permanently deleted.
• We do not sell, share, or use guest data for marketing purposes.

8. Your Content

You retain ownership of the content you upload (event details, images, messages). By using The Shindig, you grant us a license to display and transmit that content as needed to operate the service (e.g., showing your event page to guests, sending invitation emails). We won't use your content for anything else.

9. Termination

You can delete your account at any time from your account settings. When you do:

• All your events, guest data, and account information are permanently deleted.
• Any active subscription is canceled (prorated refund applies per Section 5).
• Unused credits are forfeited unless a refund is requested per Section 5.

We may also terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

10. Limitation of Liability

The Shindig is provided "as is." We do our best to keep things running smoothly, but we can't guarantee 100% uptime or that every SMS will be delivered instantly. We are not liable for missed invitations, undelivered messages, event mishaps, or any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you won't exceed the amount you've paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you via email or through the app. Continued use of The Shindig after changes take effect means you accept the updated Terms.
